Holt Renfrew Customer Research Survey - Contest Rules
HOLT RENFREW CUSTOMER RESEARCH SURVEY CONTEST RULES
NO PURCHASE NECESSARY.
Contest begins on May 6, 2019 at 12:00 PM Eastern Standard Time (EST) and ends on May 27, 2019 at 5:00 PM EST (the “Contest Period”).
Contest is open to all legal residents of Canada who have reached the age of majority in their province/territory of residence at the time of entry, who are active customers of Holt, Renfrew & Co., Limited (the “Sponsor”) and who have previously given their consent to be contacted via email for promotional purposes (the “Customer”). An active customer for the purpose of this Contest is someone who has made a purchase at the Sponsor within twelve (12) months of the Draw Date. Employees, officers, directors, contractors and agents of the Sponsor, its marketing research agency, CIRCLE6 Solutions Inc. (“Circle6”) and the Contest judges (collectively, the “Contest Parties”) and such employees’, officers’, directors, contractors’ and agents’ immediate families (parent, child, sibling & spouse and their respective spouses, regardless of where they reside) and persons living in the same households as such individuals are not eligible to enter.
HOW TO ENTER:
During the Contest Period, Customers must complete the Sponsor’s Customer Research Survey via the web link provided and will automatically be entered into the Contest. The survey is conducted on Sponsor’s behalf by Circle6. Entries will be rejected if the survey is not fully completed, submitted and received during the Contest Period. There is a limit of one (1) entry per Customer. Use of any automated system and/or repetitive submission or entries (including but not limited to entries made using any robot, macro, bot, script or contest service) is prohibited and these entries will be disqualified. All eligible entries received during the Contest Period will be entered into the random prize draw (see below).
THE PRIZE AND APPROXIMATE RETAIL VALUE:
There is a total of one (1) prize to be won consisting of one (1) Holt Renfrew gift card with a retail value of One Thousand Canadian dollars ($1000 CAD) (the “Prize”).
The Prize must be accepted as awarded and is not transferable or convertible to cash or credit. A Prize will only be awarded to the Customer who is the survey recipient and authorized email account holder. “Authorized email account holder” is defined as the person who is registered and assigned the email account by their email service provider. No Prize substitutions will be made except at Sponsor’s option. Sponsor reserves the right to substitute the Prize or any component thereof with a prize or prize component of equal or greater value, including, without limitation, but at Sponsor’s sole discretion, a cash award.
PRIZE WINNER SELECTION:
On June 4, 2019 (the “Draw Date”) in Toronto, Ontario at approximately 12:00 PM EST, one (1) eligible entrant will be selected by random draw from among all eligible entries received during the Contest Period. The odds of winning depend on the number of eligible entries received during the Contest Period.
The Sponsor will make three (3) attempts to contact the selected entrant by phone or email within three (3) business days of the Draw Date. If a selected entrant cannot be contacted within three (3) attempts or within three (3) business days of the Draw Date (whichever occurs first), or there is a return of any notification as undeliverable, then the selected entrant will be disqualified and an alternate eligible entrant will be randomly selected from amongst the remaining eligible entries. Before being declared a winner, the selected entrant will be required to: (a) correctly answer, unaided, a time limited mathematical skill testing question; and (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form confirming compliance with these Rules, acceptance of the Prize as awarded and releasing the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns from any liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of the Prize or any portion thereof. If a selected entrant: (a) fails to correctly answer the skill testing question; or (b) fails to return the Contest documents within the specified time, then he/she will forfeit the Prize and an alternate eligible entrant will be randomly selected from amongst the remaining eligible entries.
All completed and submitted surveys become the property of the Sponsor, which assumes no responsibility for lost, incomplete or illegible surveys. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Contest judges with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries.
Without limitation, the Sponsor and the Contest Parties will not be liable for any failure of the website during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer online systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Sponsor, its advertising and promotion agencies or the Contest judges for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above. Further, the Sponsor and the Contest Parties will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the Contest.
In the event of a dispute, a survey will be deemed to have been submitted by the intended survey recipient and authorized email account holder at the time of entry. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email account associated with the selected entry. The sole determinant of the time for the purposes of a valid online completed and submitted survey in this Contest will be the contest server machine(s).
The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux (“Régie”), to cancel, modify, suspend, withdraw or amend this Contest in any way, in the event of an error, accident, printing, administrative, or other error or any kind, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause that interferes with the proper conduct of the Contest as contemplated by these official Contest Rules without prior notice or obligation. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
This Contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited by law. The decisions of the Contest judges with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.
By submitting an entry, the entrant agrees that the entry complies with all conditions stated in these Rules. The Sponsor and those associated with them will bear no legal liability, expressed or implied, regarding the use of the entry by the Sponsor and THE SPONSOR SHALL BE HELD HARMLESS BY AN ENTRANT IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT THE ENTRANT HAS DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE RULES.
In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and other statements contained in any Contest related materials, including, but not limited to the French version of these Rules, and/or point of sale, print or online advertising, the terms and conditions of the English Rules shall prevail.
